1. Who we are and what these Terms cover
Songware (the “App”) is operated by FourSource d.o.o., a company based in Croatia, European Union. By using the App, you agree to these Terms. If you do not agree, please do not use the App. The App is available worldwide; some features or availability may vary by country.
2. The service
Songware is a music collaboration and sharing platform. You can create music projects, upload and share audio and project files, collaborate with other users, and discover content others have shared with you.
3. Your account
You need an account to use most features. You agree to provide accurate information, keep it current, and keep your credentials confidential. You are responsible for activity under your account.
You must be at least 16, or the minimum age for digital-service consent where you live. Younger users may only use the App with parental consent and supervision.
We may suspend or terminate accounts that violate these Terms or that we reasonably suspect of fraud, abuse, or illegal activity.
4. Acceptable use
You may not:
- Upload or share content that infringes anyone's intellectual property rights
- Upload illegal, hateful, harassing, defamatory, or otherwise objectionable content
- Distribute malware or attempt to compromise the security of the App or other users
- Try to gain unauthorised access to other accounts or to App systems
- Use automated tools (scrapers, bots) to access or extract data without our prior written consent
- Reverse-engineer or decompile the App, except where applicable law allows
5. Your content
You retain ownership of everything you upload, create, or share through the App (“User Content”). To make the App work, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, modify (for technical purposes like encoding), and display your User Content solely to operate and improve the App and to deliver it to people you've shared with. When you share content with other users, you also grant them the rights they need to access and contribute to it, according to your sharing settings.
You confirm that you have all the rights needed to upload your User Content and that it doesn't infringe anyone else's rights. You are responsible for your User Content and agree to indemnify us against claims arising from a breach of these promises.
You can report content you believe is unlawful or inappropriate to [email protected]. We may, but are not required to, review reports and remove or restrict content that breaches these Terms or applicable law, with or without notice.
6. Paid features and subscriptions
Some features may require a paid subscription or one-time purchase. All payments are processed and billed exclusively by Apple App Store or Google Play. We do not handle any payments directly.
Subscriptions auto-renew at the end of each billing period unless you cancel through your Apple ID or Google account settings before the renewal date.
Refunds and cancellations are handled by Apple or Google under their respective policies, and your rights under applicable consumer protection law (including statutory withdrawal rights for EU users) are not affected.
We may change subscription pricing or features with reasonable advance notice in the App. Changes won't apply to your current billing period.
7. Intellectual property
Everything in the App that isn't User Content — design, code, trademarks, logos, original text — belongs to FourSource d.o.o. or its licensors and is protected by intellectual property law. You may not reproduce or distribute it without our written permission.
8. Limitation of liability
The App is provided on an “as is” and “as available” basis. We do our best to keep it working, but we don't guarantee uninterrupted availability or that it will be free of errors.
To the maximum extent permitted by law, FourSource d.o.o. is not liable for indirect, incidental, or consequential damages, or for loss of data or User Content. Please keep your own backups of anything important.
Nothing in these Terms limits liability for fraud, gross negligence, or anything else that cannot be excluded by law.
9. Termination
You can stop using the App and delete your account at any time. We may suspend or terminate access for users who violate these Terms or applicable law. Licences you granted in Section 5 survive only to the extent needed to retain content shared with other users before termination, or as required by law.
10. Changes to these Terms
We may update these Terms from time to time. We'll announce material changes through the App or by email at least 14 days before they take effect. Continued use of the App after that means you accept the updated Terms.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of Croatia. Any dispute will be subject to the jurisdiction of the competent courts in Zagreb, Croatia. This does not override mandatory consumer protection rights you may have in your country of residence.
